Can anyone tell me what the code is for painting a backerboard with fire retardant paint or using flame retardant treated wood? Is this a good practice or a code? If you have a reference that would be great. If it is code where do I find the paint or flame retardant wood?

Some Jurisdictions require it. While not a code, the Ansi/EIA/TIA Building Telecom Wiring Standard states (when describing a typical Telecom Closet) :
569-A 7.2.4.1 "A minimum of two walls should be covered with rigidly fixed 3/4" plywood.....Plywood should be either fire rated or covered with two coats of fire retardant paint".
Please note that this is a quote fom the 1999 edition of the EIA/TIA standard. I can't speak for the more recent ones, but I'm sure that, if anything, they've only gotten stricter.

I've heard some locales require that the plywood be sheeted with drywall. But we've never been dinged for not painting the plywood.

The backboard should always be installed over the sheetrock. The sheetrock provides fire resistance.
Besides, I really can't see doing it before the sheetrock. It would be a big headache for the rockers to go around it unless you are a carpenter and made provisions for it with the framing.

As Hal said, it has always been my experience that the plywood goes OVER the sheetrock. I don't think the TIA is recommending anything else. I'll take a closer look at the spec, but I don't think I'll see anything different.

Here in our hospital environment we are required to apply two coats and place a sticker on the backboard from the manufacture of the paint. It gives the type of paint (FIRE rated).
We can also use backboards that have a Formica covering all the way around the plywood. They just approved this within the last couple of years.

In some areas the inspector wants to see the 'fire-rated' stencil that comes on the plywood from where ever you get it from,so we normally leave it unpainted.(the stencil that is)
On the paint,you can leave the label or a copy of it (like a snapshot) for the inspector too.

the inspector told me two coats of latex paint is ok for "fire resistance" since wood only holds up for 1 hour rating when painted.
it's all tip and ring
